Calculating the amount of marijuana in possession
Law enforcement officials use technology to identify potential areas of cannabis cultivation. If you only have one or two plants, you will be charged for each viable seedling. A conversion table is used to determine how many pounds would be yielded by the seedling. If you have hundreds and hundreds of seedlings with root structures, you may be held accountable for 25,000 to 45,000 pounds of marijuana based on what the plant could potentially produce in a given period of time. In Federal Court, each plant, regardless of sex, is treated as 100 grams of marijuana under the Federal Sentencing Guidelines [§2D1.1 note (E)].
